Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of precisionaerialdiagnostics.com and services offered by DUTELA LLC, doing business as Precision Aerial Diagnostics (“Precision Aerial Diagnostics,” “PAD,” “we,” “us,” or “our”). By using the website, submitting a request, scheduling a call, or purchasing services, you agree to these Terms.
1. Services and Scope
PAD provides aerial roof and property visual documentation, generally consisting of high-resolution photographs, organized digital folders, and repeatable views when feasible. Unless a signed written agreement expressly states otherwise, PAD does not provide formal inspections, certified or professional measurements, damage determinations, causation opinions, engineering opinions, code-compliance conclusions, insurance adjusting, coverage conclusions, claim decisions, or guaranteed regulatory outcomes. Deliverables are not a substitute for evaluation by an appropriately licensed or qualified professional.
2. Requests Are Not Confirmed Assignments
A form submission, telephone conversation, AI interaction, chat, qualification call, payment attempt, or requested date does not by itself confirm a flight or assignment. Final acceptance, scope, pricing, deliverables, timing, access, and flight feasibility remain subject to PAD’s confirmation.
3. Pricing, Payment, Delivery, and Promotions
Prices shown on the website apply only to the stated standard scope and may change for future orders before acceptance. Multi-structure, commercial, specialized, recurring, restricted, unusually large, or otherwise nonstandard projects may require scope review and a custom written proposal. Current core prices are Roof & Property Documentation at $299 per qualifying visit, Construction Snapshot at $399 per qualifying visit, and Construction Progress Plan at $749 per billing month.
Standard Delivery. Standard deliverables are provided within 48 elapsed hours after completion of fieldwork. The delivery clock begins after PAD completes the scheduled on-site fieldwork and the flight has been legally and safely completed—not when the order is placed, payment is submitted, or an appointment is requested.
24-Hour Delivery. For a one-time qualifying visit, 24-Hour Delivery is $99 for that visit. For the Construction Progress Plan, the upgrade is $99 per billing month and produces an $848 recurring monthly total. It applies to both qualifying completed visits included in that billing month and recurs with the plan until removed or future renewal is canceled. Deliverables from each qualifying completed visit are provided within 24 consecutive elapsed hours after that visit’s legal and safe fieldwork is completed; each visit has its own delivery clock. The upgrade does not accelerate scheduling, weather clearance, airspace authorization, site access, safety review, or fieldwork. If PAD misses the qualifying commitment for one or both Progress Plan visits during a billing month for reasons within its reasonable control, PAD will refund the applicable $99 monthly upgrade fee—not $99 per visit and not automatically the properly performed underlying plan. Customer-caused delay, missing information, requested work outside the purchased scope, file-delivery platform outages, force majeure, and extraordinary circumstances may affect the available remedy. Custom-scope timing may be established separately in writing.
Professionally Edited Video promotional deliverable. The professionally edited video is currently included automatically as a complimentary promotional deliverable with each qualifying completed visit. No customer request, selection, checkbox, opt-in, or separate form is required. When sufficient usable footage is safely and legally captured, Precision Aerial Diagnostics targets a minimum finished duration of 60 seconds, with no fixed maximum. Final runtime is determined by the project, usable footage, operational feasibility, and Precision Aerial Diagnostics’ reasonable editorial judgment. A shorter video or no video may result when safety, legality, feasibility, or insufficient usable footage prevents production of a qualifying video. The promotional offer does not include unlimited footage, runtime, editing complexity, revisions, or production labor. The promotional video has no cash-refund or transferable-credit value and may be changed or withdrawn for future purchases.
Additional Structure — $199. One additional structure on the same property or project site, up to approximately 5,000 square feet of roof footprint and within approximately five acres of the primary documented structure. Projects beyond these limits or involving three or more structures require a custom scope, including written delivery timing.
4. Scheduling, Cancellation, Weather, Airspace, and Safety
All flights are subject to weather, airspace, FAA requirements or authorization, lawful property access, site conditions, safe operating conditions, equipment status, confirmed scope, and pilot availability. PAD may postpone, modify, or decline an operation when reasonably necessary for safety, legality, or feasibility. No requested date, qualification call, automated message, or AI response confirms a drone mission.
Customer cancellation and rescheduling. Cancellation at least 48 hours before the scheduled appointment qualifies for a full refund of services not performed. Rescheduling will ordinarily be offered when practical. PAD does not publish or impose an unapproved late-cancellation fee. A cancellation less than 48 hours before the appointment will be reviewed based on the circumstances, work performed, and applicable law.
PAD or operational cancellation. If PAD determines that a project cannot legally, safely, or reasonably be completed because of airspace, access, safety, regulatory restrictions, property characteristics, or operational infeasibility, PAD may offer rescheduling, an adjusted or custom scope, or a refund for the unperformed service.
Weather. Weather delays ordinarily result in rescheduling. If PAD ultimately cannot perform a purchased service within a commercially reasonable period, PAD will refund the amount paid for the unperformed service.
5. Customer Responsibilities
You represent that you are authorized to request documentation at the property and to provide PAD with the information and access reasonably necessary to perform the agreed service. You are responsible for accurate property, contact, access, hazard, restriction, and project information; obtaining permissions within your control; identifying known hazards or privacy concerns; and ensuring that the site-access contact is available as agreed. PAD may rely on the information you provide.
6. Deliverables and Permitted Use
Deliverables will be limited to the confirmed written scope. Image quantity, viewpoints, visibility, coverage, and repeatability depend on site and flight conditions and are not guaranteed unless expressly confirmed in writing. You may use paid deliverables for your internal business, estimating, project communication, before-and-after documentation, and other lawful purposes consistent with the confirmed scope. You may not remove ownership notices, misrepresent the content, use it unlawfully, or present visual documentation as a PAD inspection, damage finding, engineering conclusion, or insurance decision.
6A. PAD Deliverable Satisfaction Guarantee
If the photographs or included edited video delivered by Precision Aerial Diagnostics materially fail to match the written deliverables you purchased, notify us within seven calendar days of delivery and explain the specific concern. We will review it promptly and, when the guarantee applies, provide a commercially reasonable correction, replacement imagery when a safe and legal reflight is feasible, or a refund of the amount paid for the affected service or paid add-on if we cannot reasonably correct or replace it.
The guarantee applies to conformity with PAD’s written deliverables. It does not guarantee detection of a particular condition; an insurance, claim, estimating, sales, repair, or business outcome; or acceptance by an unidentified third party. It does not convert the service into an inspection, measurement, engineering opinion, appraisal, damage assessment, causation analysis, or insurance opinion. Conditions outside PAD’s reasonable control may limit available imagery. Complimentary promotional deliverables have no cash-refund value. PAD is not required to perform an unsafe, unlawful, impossible, or commercially unreasonable reflight. Nothing in this policy waives rights that cannot lawfully be waived.
6B. Refunds, Completed Work, Add-ons, and Erroneous Charges
After fieldwork, refunds are not automatic merely because imagery does not produce a hoped-for outcome. Genuine deficiencies in the written deliverables are handled through the PAD Deliverable Satisfaction Guarantee. When PAD cannot provide a commercially reasonable correction or feasible replacement, PAD may refund only the affected paid service or paid add-on. Complimentary promotional value is not refundable as cash. Verified duplicate or erroneous PAD charges will be reviewed promptly and corrected.
6C. Construction Progress Plan
Customers may cancel future recurring billing before the next renewal date shown by checkout. Cancellation stops future renewal; it does not automatically refund completed visits. If neither monthly visit has occurred, PAD will review the current payment for refund or rescheduling based on the circumstances. If one of the two monthly visits has occurred, PAD may refund only the reasonable amount attributable to the unperformed visit. Completed visits are nonrefundable except when the PAD Deliverable Satisfaction Guarantee applies. Already scheduled but unperformed visits are canceled when the recurring plan is canceled unless PAD and the customer agree otherwise. There is no minimum commitment. PAD does not promise automatic proration. Unused visits do not roll over into future billing periods.
7. Qualification Calls
Project qualification calls are for gathering information and discussing potential fit. A booked or completed call does not confirm pricing, a flight, availability, deliverables, regulatory approval, or turnaround.
8. Communications
By providing contact information, you authorize PAD to respond to your inquiry and send transaction-related communications. Optional marketing or SMS consent is governed by the disclosure presented where consent is requested. Consent to promotional SMS is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out of SMS and HELP for help.
9. AI and Recorded Interactions
PAD may use an AI receptionist, AI chat, transcription, or summaries to collect and route information. AI-generated information may be incomplete or inaccurate and does not modify an agreement or authorize final pricing, flight availability, findings, regulatory approval, or insurance outcomes. Calls or interactions may be recorded or transcribed where permitted by law and with applicable notice or consent.
Certificate of Insurance. Precision Aerial Diagnostics carries commercial aviation liability insurance. If a company requires a Certificate of Insurance (COI), it may request one through the website chat. The chat assistant will notify our team, and the appropriate redacted certificate will be provided for legitimate vendor or project review. A request does not confer additional-insured status.
10. Website Information
Website content is provided for general information and may be changed without notice. We do not warrant that the website will be uninterrupted, error-free, current, or suitable for a particular purpose. Any examples, portfolio materials, estimated timing, or service descriptions are illustrative unless incorporated into a confirmed written scope.
11. Intellectual Property
The website, branding, text, graphics, systems, and other PAD content are owned by PAD or its licensors and protected by applicable law. Except for the limited permitted use of paid deliverables described above, no rights are granted without prior written permission.
12. Prohibited Use
You may not misuse the website or services; attempt unauthorized access; introduce malicious code; interfere with operations; submit false, unlawful, infringing, or deceptive requests; violate privacy or property rights; or use deliverables to misrepresent PAD’s conclusions or credentials.
13. Third-Party Services
PAD may rely on third-party providers for hosting, CRM, communications, telephone, AI, payment processing, analytics, storage, maps, calendars, and delivery. Their services and terms may apply, and PAD is not responsible for outages or acts outside our reasonable control.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” PAD disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. PAD does not warrant that visual documentation will reveal every visible or hidden condition or satisfy any third party’s requirements.
15. Limitation of Liability
To the fullest extent permitted by law, Precision Aerial Diagnostics will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, business, or opportunity; or decisions made by you or third parties based on the deliverables. Precision Aerial Diagnostics’ aggregate liability arising from a specific paid service will not exceed the amount paid to PAD for that service, except where applicable law prohibits such a limitation.
16. Indemnification
You agree to defend, indemnify, and hold PAD and its owner, personnel, and service providers harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use, inaccurate information, lack of authority or access permission, violation of these Terms, or misuse or misrepresentation of deliverables.
17. Delaware Law
These Terms are governed by Delaware law, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Delaware, unless applicable law requires otherwise.
18. Changes, Severability, and Entire Agreement
We may update these Terms by posting a revised version with a new effective date. If any provision is unenforceable, the remaining provisions remain effective. These Terms, together with the confirmed proposal, order, or written scope and our Privacy Policy, form the agreement relating to the applicable website use or service. A specific signed written agreement controls if it expressly conflicts with these Terms.
